Exposure of Sexual Organs in Florida

Exposure of Sexual Organs occurs when a person vulgarly or indecently exposes their sexual organs.

Exposure of Sexual Organs, which is more commonly referred to as Indecent Exposure, occurs when a person vulgarly or indecently exposes their sexual organs.

Definition of Exposure of Sexual Organs

Under Florida Statute 800.03, the crime of Exposure of Sexual Organs is committed when a person vulgarly or indecently:

  • Exposes their sexual organs in public, on the private premises of another person, or so close as to be seen by another person in their own private premises; or
  • Appears naked in public.

Penalties for Exposure of Sexual Organs

In Florida, the crime of Exposure of Sexual Organs is a First Degree Misdemeanor and punishable by up to one (1) year in jail, one (1) year of probation, and a $1,000 fine.

A judge may sentence a person convicted of Exposure of Sexual Organs to probation, but may also impose a sentence up to the statutory maximum of one year in jail.

Exposure of Sexual Organs with Prior Convictions

A person with a previous Exposure of Sexual Organs conviction is guilty of Exposure of Sexual Organs with a Prior Conviction.

Exposure of Sexual Organs with a Prior Conviction is a Third Degree Felony punishable by up to five years in prison, five years of probation, and a $5,000 fine.

Under Florida’s Criminal Punishment Code, Exposure of Sexual Organs with a Prior Conviction is assigned a Level 1 offense severity ranking and a judge may sentence a person convicted of Exposure of Sexual Organs with Prior Convictions to probation.
